88TES3P-FSP not working at gen2 speeds!

I've had this card for a couple of years. Today i was using it to validate some Gen2 support on a motherboard i'm working on and noticed that the card isn't advertising Gen2 capable in the link capability register. Is there some way to update the firmware (or a hardware mod) to make it work at Gen2 speed?

I've confirmed with my tools that it's negotiating at 2.5GT/s.
